Terms and Conditions

THESE TERMS AND CONDITIONS (” TERMS” ) APPLY TO ANY COURSE PROVIDED BY US THAT IS BOOKED VIA www.Fun Vibes Active Lives.org.uk (” WEBSITE” ). PLEASE READ THESE TERMS AND CONDITIONS BEFORE MAKING A BOOKING BECAUSE YOU WILL BE BOUND BY THEM ONCE A CONTRACT COMES INTO EFFECT BETWEEN YOU AND US IN ACCORDANCE WITH ALL CLAUSES. BY FILLING OUT THE BOOKING FORM AND CLICKING “CONTINUE” YOU ARE DEEMED TO AGREE TO THESE TERMS.

YOU SHOULD PRINT A COPY OF THESE TERMS FOR FUTURE REFERENCE.

Please note - When booking onto HAF provision, please note that there is a requirement of the HAF programme to check the eligibility of participants of the programme using the Government Free School Meal portal.

1 Information about us

  1. 1.1 References in these Terms to “we” or “us” are references to Spring North Consortium (Registered Charity Number: 1150126)

  3. 1.3 The Booking Page is operated by Spring North Ltd (Company Number 07797133), Room 103, 1 Exchange Street, Blackburn, BB1 7JN.

2 Your Booking

2.1 By filling out a booking form via the Website and clicking “Book Now” you are submitting a request to book a place on the specified FUN VIBES ACTIVE LIVES Summer holiday project. All requests are such acceptance to you by sending an email to the address that you provide during the booking process to confirm the details of the booking and that the booking has been confirmed (“Booking Confirmation“).

2.2 At the point we send the Booking Confirmation a legally binding agreement is formed between you and us on these Terms (“Agreement ”).

2.3 The various Fun Vibes Active Lives daily programmes are subject to change at any point and we advise you to check the website regularly. If we have to make changes where possible we will also notify you of this directly by email.

2.4 By making a booking you warrant that you are at least eighteen years of age and a UK resident.

3 If you have to cancel a booking

3.1 To cancel a booking and terminate this send us an e-mail explaining that you would like to cancel and stating your name and the booking reference included in the booking confirmation. This will help us to reallocate your free place to another child on our waiting list.

4 Staff

4.1 We confirm that all our partner staff and coaches have been subject to Disclosure and Barring Service (DBS) checks (previously CRB checks) and hold suitable professional qualifications.

5 Photographs and images

5.1 Please note that from time to time we may take pictures of the children who take part in a activities and these photographs may be used for promotional reasons associated with the FUN VIBES ACTIVE LIVES project. If you do not wish your child to be photographed please notify the customer services contact set out in Clause 1 above. You may have confirmed that it is okay to use images of your child during the booking process.

6 Liability

6.1 You will be required to accept a disclaimer at the time of booking confirming certain information and accepting that, in the absence of any negligence on our part, participation in the project is at your own risk (“Disclaimer“).

6.2 We have public liability insurance cover of at least £5 million.

6.3 No liability will be incurred if your child did not follow proper instructions given to them during their visit to the FUN VIBES ACTIVE LIVES project.

6.4 We do not accept liability for loss or theft of personal belongings that occurs while on the project. If your child brings valuables with them this will be at your risk.

7 Complaints

7 We are committed to ensuring your child has a great experience but if you or your child is not entirely happy with its experience please contact us. If your complaint has not been resolved to your satisfaction please contact us using the contact details in Clause 1 with full details of the complaint and we will attempt to resolve this for you.

8 Medical / Dietary / Other Requirements

If any child included on your Booking:

has specific dietary requirements; is taking medication; has allergies; and/or has any special needs that will affect his or her participation in activities. It is your responsibility to inform us of this and provide all necessary details about this at the time of booking.

8.1 Please note that our staff are not permitted to take responsibility for or to administer medicines and therefore you are responsible for ensuring any medicine is administered before the attending the activities daily.

8.2 Children will be provided with a meal and refreshments during their visit to the Fun Vibes Active Lives project. Staff will make every effort to ensure that food is sensitive to the dietary, religious and cultural requirements of all children as detailed on the booking form.

8.3 We will maintain a register of children attending each day. Please note that it is your responsibility to sign in at the beginning of each day and collecting your child at the end of the day.

9 Discipline

9.1 Children attending our project will be treated with respect and must treat others with respect. We reserve the right to terminate this agreement and refuse to allow your child to continue attending an activity location if our partners and staff deem their behaviour to be unacceptable.

10 Data Protection

10.1 The Website is operated by Spring North. When you make a booking via the website Spring North will collect and process the personal information you provide in order to provide the services you have requested and for other specific purposes subject to your consent. To learn more about what information is collected, the measures Spring North puts in place to protect this information and how it is used we advise you to read the website Terms of Use and Privacy Policy.

11 General

11.1 We can transfer any of our rights or obligations arising under this agreement to another person at any time, but this will not affect your rights. You may not transfer your rights and obligations arising under this agreement without our prior written consent.

11.2 If any court or competent authority decides that any of the provisions of this agreement are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

11.3 These Terms and the Disclaimer set out the whole of the Agreement between you and us in relation to the subject matter of this Agreement and supersede any prior agreement, understanding or arrangement between us about such subject matter whether oral or in writing.
